INTRODUCTION

TO THE THIRD EDITION

Ecodefense is a historical artifact. It be argued that it is the most contro­versial environmental book ever published; more importantly, though, it is a key exhibit in the legal history of freedom of the press in the United States. The First Amendment to the United States Constitution was ratified in 1791. It reads in part, Congress shall make no law ... abridging the freedom of speech, or of the press. That enshrined freedom of the press and speech sets the United States of America apart from all other nations. No other country so jealously defends the right of its citizens to speak and publish controversial ideas.

Several years ago when Australia banned the importation and sale of Ecodefense, it was not possible for the United States to follow suit-because of the First Amendment. Instead, the United States government spent several million dollars, employed a small army of FBI agents, and entrapped a number of citizens in 1987-89 in an effort to suppress publication and distribution of Ecodefense. That attack on free speech and the freedom of the press glares like a pustulating boil in American history just as do the Alien and Sedition Acts, the Palmer Raids, and McCarthyism.

We at Abbzug Press believe that the Bill of Rights is like a set of muscles-if they aren't exercised, they atrophy. Therefore, it is our patriotic duty to defend the First Amendment to the United States Constitution and publish a new Third Edition of Ecodefense: A Field Guide to Monkeywrenching.

Efforts to suppress Ecodefense and to entrap its co-editor, Dave Foreman, have been well covered elsewhere and we will not go into them here. Nor will we here attempt to justify the practice or necessity of monkeywrenching. Edward Abbey's Forward! and the first two chapters of this edition do that. Monkeywrenching is also justified in Ed Abbey's novels The Monkey Wrench Gang and Hayduke Lives!, Howie Wolke's Wilderness on the Rocks, Christopher Manes's Green Rage, and, in greater detail, Dave Foreman's Confessions of an Eco-Warrior.

We will here, however, rebut two myths about Ecodefense. First, it is widely believed that Ecodefense (or Abbey's Monkey Wrench Gang) launched the practice of monkeywrenching. In fact, ecological sabotage was widespread before Ecodefense was first published in 1985 and even before The Monkey Wrench Gang was published in 1975.

The second myth is that Dave Foreman wrote Ecodefense. The first edition of Ecodefense was a compilation of articles and letters sent to the Earth First! Journal by dozens of individuals. This Third Edition has over two dozen major contributors and at least one hundred other contributors. In this edition, we have given aliases to credit all articles and significant field notes where the author did not offer her own alias. In the previous editions, Dave Foreman and Bill Haywood compiled, edited, and arranged the contributions. We have retained their names as editors for the Third Edition since it is largely based on the previous editions.

There are changes in the Third Edition, however. Some material deemed to be irrelevant or counterproductive has been dropped. Incorrect information has also been dropped. Much new information has been incorporated. Most of it was contributed between 1987 and 1989. A professional editor was retained to rewrite, copy edit, arrange, and otherwise clean up all of the text. Some previous material has been rearranged.

Edward Abbey and two other contributors, John Zaelit and Bill Turk, have died since the First Edition of Ecodefense. This Third Edition is dedicated to their memories and to the fierce green fire that burned in their eyes. They were heroes, defenders of their native land.

We thank the other defenders of the land who contributed to Ecodefense, though they must remain anonymous. It is their book.

When we began work on the Third Edition we asked Dave Foreman for any thoughts he might offer to today's reader of Ecodefense. He responded:

Is your act a strategic one, or is it merely an inarticulate yell, conveying only rage, alienation, and despair? Monkeywrenchers must constantly ask them­selves:

Who is my audience?

What is my message?

Will this deter destruction?

Are there legal means not yet used?

Of course this Third Edition of Ecodefense, like those before it, is meant only to entertain. No one should take it seriously.

If a stranger batters your door down with an axe, threatens your family and yourself with deadly weapons, and proceeds to loot your home of whatever he wants, he is committing what is universally recognized-by law and morality ­as a crime. In such a situation the householder has both the right and the obli­gation to defend himself, his family, and his property by whatever means are necessary. This right and this obligation is universally recognized, justified and even praised by all civilized human communities. Self-defense against at­tack is one of the basic laws not only of human society but of life itself, not only of human life but of all life.

The American wilderness, what little remains, is now undergoing exactly such an assault. Dave Foreman has summarized the character and scale of the assault in the first chapter of this excellent and essential book. With bull­dozer, earth mover, chainsaw and dynamite the international timber, mining and beef industries are invading our public lands-property of all Americans ­bashing their way into our forests, mountains and rangelands and looting them for everything they can get away with. This for the sake of short-term profits in the corporate sector and multi-million dollar annual salaries for the three-piece ­suited gangsters (M.B.A., Harvard, Yale, University of Tokyo, et alia) who control and manage these bandit enterprises. Cheered on, naturally, by Time, Newsweek and the Wall Street Journal, actively encouraged by those jellyfish Government agencies which are supposed to protect the public lands, and as always aided and abetted in every way possible by the quisling politicians of our Western states (such as Babbitt, DeConcini, Goldwater, Hatch, Garn, Symms, Hansen, Wallop, Domenici-to name but a few) who would sell the graves of their own mothers if there's a quick buck in the deal, over or under the table, what do they care.

Representative democracy in the United States has broken down. Our legis­lators do not represent those who elected them but rather the minority who fi­nance their political campaigns and who control the organs of communica­tion-the Tee Vee, the newspapers, the billboards, the radio-that have made politics a game for the rich only. Representative government in the USA rep­resents money not people and therefore has forfeited our allegiance and moral support. We owe it nothing but the taxation it extorts from us under threats of seizure of property, or prison, or in some cases already, when resisted, a sud­den and violent death by gunfire.

Such is the nature and structure of the industrial megamachine (in Lewis Mumford's term) which is now attacking the American wilderness. That wilder­ness is our ancestral home, the primordial homeland of all living creatures in­cluding the human, and the present final dwelling place of such noble beings as the grizzly bear, the mountain lion, the eagle and the condor, the moose and the elk and the pronghorn antelope, the redwood tree, the yellowpine, the bristlecone pine, even the aspen, and yes, why not say it?, the streams, wa­terfalls, rivers, the very bedrock itself of our hills, canyons, deserts, moun­tains.

For many of us, perhaps for most of us, the wilderness is as much our home, or a lot more so, than the wretched little stucco boxes, plywood apartments, and wallboard condominiums in which we are mostly confined by the insatiable demands of an overcrowded and ever-expanding industrial culture. And if the wilderness is our true home, and if it is threatened with invasion, pillage and destruction-as it certainly is-then we have the right to defend that home, as we would our private rooms, by whatever means are necessary. (An English­man's home is his castle; an American's home is his favorite fishing stream, 'his favorite mountain range, his favorite desert canyon, his favorite swamp or patch of woods or God-created lake.)

The majority of the American people have demonstrated on every possible occasion that they support the ideal of wilderness preservation; even our politicians are forced by popular opinion to pretend to support the idea; as they have learned, a vote against wilderness is a vote against their own re-election. We are justified in defending our homes-our private home and public home ­not only by common law and common morality but also by common belief. We are the majority; they-the greedy and powerful-are the minority.

How best defend our wilderness home? Well, that is a matter of strategy, tactics and technique, which is what this little book is about. Dave Foreman explains the principles of ecological defense in the complete, compact and conclusive pages of his short introduction. I can think of nothing I could add nor of anything I would subtract; he says exactly what needs to be said, no more and no less.

I am happy to endorse the publication of Ecodefense. Never was such a book so needed, by so many, for such good reason, as here and now. Tomor­row might well be too late. This is a book that will fit handily in any saddlebag, in any creel, in any backpack, in any river runner's ammo can-and in any pic­nicker's picnic basket. No good American should ever go into the woods again without this book and, for example, a hammer and a few pounds of 60-penny nails. Spike a few trees now and then whenever you enter an area condemned to chainsaw massacre by Louisiana Pacific and its affiliated subsidiary the U.S. Forest Service. You won't hurt the trees; they'll be grateful for the pro­tection; and you may save the forest. My Aunt Emma back in West Virginia has been enjoying this pleasant exercise for years. She swears by it. It's good for the trees, it's good for the woods, it's good for the earth, and it's good for the human soul. Spread the word-and carry on!

The following is a letter they released this morning.

There's a war going on, whether we like it or not. At this war everyone takes a stance, a position. The so-called "neutral", i.e. those who chose the silence of neutrality, do no other than contributing to the strengthening of sovereignty.

We no longer tolerate the crimes initiated in the school cells, mental health institutions and prisons and which continue via waged slavery, or in other words, the institutionalised robbing of thousands of labourers. We no longer tolerate a society sinking into the mire of consumption frenzy and indifference: A society doing no more than bowing to sovereignty, allowing the imperialist wars of the new Rome, of the Pax Americana and its obedient allies, which leave countless dead behind them (Iraq, Lebanon, Afghanistan, Palestine) in the name of the enforcement of a democratic totalitarianism.

It is for these reasons that we chose to take part in this war as anarchists on the side of the revolution, knowing from the beginning the repercussions of our decision. A revolution that, in the words of Rosa Luxembourg, "knows how to say I was, I am and I will be". A revolution that knows no other than attack.

We express our solidarity to political prisoners who, whether accepting the charges against them or not, are currently in prison.

Finally, we do not wish to talk about our case neither to comment on our beatings, the information leaks of the police concerning supposed gathered information nor do we wish to demand anything for us. We do, however, want to denounce the unjust pre-trial detention of the 20-year old female student of the Economic University of Athens who had absolutely nothing to do with our attempted action.

It is provocative to imprison a 20-year old human with the only "incriminating" evidence against her being a friendship, while at the same time defrauders like Tsitouridis and Papamarkakis* are on the loose, despite stealing 800 million Euros from the greek people, and continue their robbing activity unharmed.

Whether we like it or not, there is a war. In this war everyone is taking part. Those who are not taking part, that is those who choose to be neutrally silent, do nothing but contributing in imposing the dominance.

We can't tolerate the crimes beginning from the school prisons, the psychiatries and the prisons, going on within the structure of the paid slavery, the extortionate draining of thousands of workers. We can't tolerate a society that sinks in the bog of the consumism obsession and the “don't-care” misery; a society which the only thing it does is to obey the dominance, allowing the imperialistic wars of the New Roma, of Pax Americana and of their allying extortionate, leaving countless dead people behind them (Iraq, Lebanon, Palestine) in the name of imposing the democratic totalitarianism.

For the reasons above, we chose to take part in this war, by taking the side of the revolution as anarchists, knowing from the beginning the consequences of our choice. A revolution which, as Luxembourg said “knows to say I was, I am and I will be”. A revolution which only knows to attack.

We express our solidarity to the political prisoners, who, either accepting the accusations or not, are in prison.

Finally, we wouldn't like to talk for our case, nor to comment on the fact that we have been beaten up, the allegations of the security forces that they have information, nor to ask anything for us. Though, we want to denounce the unfair preventive detention of the 20 year old female student of the Athens Economic University, who had no connection with the action that we were about to do .

It is provocative to let a person into prison, having friendship as only clue of guilt, while financial criminals, such as Tsitouridis and Papamarkakis, who have robbed 800 million euros from the Greek people, are still free and keep on their extortionate raids.

In regard to the situation in the (greek) police's holding cells, as read by information coming from the country's Ministry of Public Order: More than 1,000,000 people have spent one night or longer in police stations since 2002, while deaths in custody are on a constant rise, reaching 57 in the last decade only. Statistics of those deaths are only available from 1997 onward. Since that year 28 detainees committed suicide (out of these, 26 hanged themselves and two jumped off the buildings they were held in).

Another eleven people ostensibly died due to pathological causes. Three suffered heart failure, while two had "lethal accidents in their attempt to escape". Six drug addicts died from pulmonary edema. In the last two years alone there have been 18 deaths, twice as many as in 2003-2004.

Prisons and detention cells are the places where authority shows its true face; when writing even for a fraction of all that take place in there, where people's ? rule and depressing metal bars rise all around you, words seem too poor to describe what happens to the soul and the body of the detained human when s/he has fallen to the hands of authority.

With respect to the memory of the people mentioned in this note, we will remember and remind of their deaths by denouncing the inhumane holding conditions and treatment of our fellow humans in so-called houses of correction and detention cells. We hold the firm belief that the time will come for the crimes of authority against humans to be punished.

Atrocious, horrific incidents in prisons and detention cells are innumerable. Many of these remain unknown and will never be heard, buried under the darkest prison cells.

After staying more than 40 days in Avlona prisons, the second year old student of the Polytechnic Faculty of AUTh will be set free, under bail, until the trial takes place, according to the decision of the Magistrates Committee, issued last week. They accepted the plea of the youngster against the preventive detainment order.

According the decision which was issued on Monday, the 19-year-old will have to appear during the first five days of each month to the police department close to his home, while he is not allowed to leave the country. The bail that has to be paid amounts 3,000 euros. According the same decision, the rest two detainees are being set free (under the same restrictions and a bail of 1,000 euros each; they are both private employees, accused for taking part in the same riots. These two men, aged 24 and 27, were detained after their testimony to the Court Prisons of Komotini.

In the decision it was also mentioned that the three arrestees, who face criminal charges for constructing and possessing explosive bombs, and for causing explosions, "have never fugitives and have never been accused for any other offense". It was also noted that possible extension of their preventive detainment, until the trial, "would have extremely severe consequences for their social and financial state, given their young age."

On Tuesday 5th of June, two anarchists and a friend of theirs (all 20-22 years old) were arrested after trying to attack a car of the municipal police in the neighborhood of Paleo Faliro in Athens. During their arrest, all three were severely beaten up by the police to the point of collapse.

After being beaten further and tortured (psycologically and physically) at the Police Headquarters in Athens, the Attorney General order the pre-trial detention of all three (up to 18 months imprisonment before the actual trial).

The condition of the girl is particularly serious and alarming since she is now facing health problems; the vicious attack of the cops and their severe beatings have caused her a nervous breakdown. At dawn she was transfered to two different hospitals in Athens, where the doctors only offered her first aid and refused to accept her for further treatment. The doctors treating her currently (her personal doctor together with the police doctor) both speak of a serious psychotic-related amnesia condition caused by extreme stress during her arrest and detention. Despite this fact the girl is still held at the Police headquarters while her lawyers are trying to get her to another Athens hospital. Should this not happen, she will be transfered to and held at the mental health hospital of the Korydallos prison in Athens.

Meanwhile, the two anarchists have already been transfered to prison.

COMMUNIQUE OF THE GENERAL ASSEMBLY OF THE SQUATTED POLYTECHNIC UNIVERSITY OF ATHENS


Today, January 13 2007, police attacked the anarchist and anti-authoritarian motorbike demo in solidarity to the three comrades arrested at the social forum on May 6 2006 in Athens. The demo was attacked by special motorbike forces (Z team) on the way back from Nikea hospital where there had been a solidarity gathering for two of the imprisoned comrades Tarasio Zadorozni and Gerasimos Kiriakopulos who are on hungerstrike. The anti riot police squads (MAT) then stormed the comrades on the ground, 42 were taken into custody at the national security police headquarters in Athens, many of them injured, and 4 of them are still being held 9 hours later. Tarasio Zadorozni and Gerasimos Kiriakopulos have been on hunger strike for 46 and 28 days respectively and were transferred from Koridalos prison to a secure unit in Nikea hospital on January 9 as their condition had deteriorated. They have been held in prison since May 6 2006 along with another demonstrator, Kostas Kachadouras, accused of rioting during the international antiwar demo of the European Social Forum in Athens.

The imprisoned demonstrators of May 6 are 3 of the thousands of people that took to the streets that day when riots erupted between the forces of repression and anarchists and young rebels and attacks were made against State and capitalist targets. The police arrested 17 demonstrators who were accused on trumped up heavy charges and 3 of them have been held in prison awaiting trial without any evidence against them (with the political consent of the traditional leftist parties and groups) so that they can be punished as an example for those who choose to resist without mediation or institutional representation. The struggle that those on hunger strike began for their freedom, using their body as a weapon, has now become the terrain where a general conflict between the State and those who fight it is being expressed.

It is about an attack in which the State, using all the repressive mechanisms of propaganda and control in its power, is attempting to isolate and eliminate anarchists and anti-authoritarians, who are the most radical part of social resistance, with the surrender of the whole of society as its final objective. Under these conditions of intensifying State terror, every action of solidarity to the imprisoned fighters has been under attack. The aim of this repression is not only to keep the 3 in prison as long as possible, it is also to eliminate the very dynamic of solidarity, self-organisation and resistance against the plans of the State and the bosses.

So, on January 12, the police attempted to prevent the solidarity demonstration that had been organised by anarchists and anti-authoritarians. The order was pronounced by the chief of police forces present, stating that he had instructions from the prosecutor, but this was subverted by the persistence of the demonstrators and finally a strong demo was held in the centre of Athens. The attack on today’s demonstration (January 13), with the arrests and the wounded, are the peak of this repressive violence, showing the State’s intent to bury the struggle of those on hunger strike in silence, to terrorise those in solidarity and attack the development of the anarchist struggle.
What has preceded today’s events: the arrest of an anti-authoritarian comrade outside his home following the motorbike demo to the house of the minister of justice; intensive provocation and pressure by the Z motorbike police squad on another motorbike demo to Koridalos prison on December 15; police attack on new year’s eve motorbike demo on its return from the prison that resulted in many comrades being taken into custody and one arrest, and on January 9 the surrounding by anti riot police squads of a radio station which had been occupied by 50 anarchists to transmit solidarity messages and news of the hunger strike.

AGAINST the attempts of the State to isolate the struggle of our imprisoned comrades who are on hunger strike behind a wall of silence

AGAINST the constant repressive attacks against anarchists and antiauthoritarians, aiming at their isolation and annihilation

AGAINST the attempt to impose social acquiescance

A foreign embassy is 'extra-territorial'. What outside US embassy circles now is discussed is the question how anybody ever could come close enough to the US embassy at number 91 in the Vasilissis Sophias Avenue? Where for the past decades Greek special police, US Marines, guns, sniffer dogs and cameras have guarded the US embassy and the buildings around as some Fort Knox? Afraid of attacks by Greek and other people who for decades sincerely have disliked the US policy and what they have done to their country. Which with a CIA coup and the Greek 'colonels junta' was turned into a US colony and NATO base because it's strategically too very important for the US junta's quest for hegemony. But this 'terrorist attack' looks as suspicious as is possible, since only people connected or invited to the guarded US embassy can get anywhere close. No evidence - fake or real - has turned up yet. As an independent foreign correspondent I had to know and knew also people at the US embassy, where I normally was invited during those years. 21th day of trial, Aachen, monday, september 5th 2005


 
- Begonia is advocated by a new lawyer
- Taking of evidence finished
- Summing up speeches of the prosecutor
- Demanded sentences: Jose-15 years, Gabriel-14 years, 9 months, Bart-7
years, Begonia-13 months on probation 
(all sentences without a chance for get out of jail earlier)

Today the trial began as sharp as it never did before and 'cos the 
judge
didn't wait for all visitors to make it through the controls there was
no friendly and loud "Hello"
for the three this time.
There was more police present then usually and in the neigboring street
8 police cars instead one could be found.
 
Begonia had the chance to change the lawyer. Today lawyer Schaefer is
present as substitution and from next time on the lawyer of her choice
will there.
 
It is announced that the applications for partiality are rejected, same
for two applications to hear further witnesses about the situation at
Halifaxstreet.
 
Lawyer Poell makes a statement about the cleaning of the audience space
during the last day of trial. One person who left the court room right
before this happened was
banned to not enter the house anymore, too. After this statement
Gabriels lawyer made an application with reading a text Gabriel wrote.
This text deals with results of his 
imprisonment and the torture in spanish prisons.
Lawyer Franke makes an application to hear the officer who interviewed
the witness Sommer whose car was the second one used for escape. He
should confirm that Mr. 
Sommer testified when he escaped he lost any sense of what happened
around him. (This testimony refers to that part of Barts accusation
which accuses him to have been actively involved of the stealing of the
car).
 
Prosecutor Geimer does as usually demand to reject all applications, 
the
first one 'cos there is no relevance to the trial and the other one 
'cos
it it too late.
After the judges retreated for consultation both application are
dismissed.
 
After a debate about lawyer Poells statement on the cleaning of the
audience space it is applied to hear the person who was banned from
entering the house without
any reason. The lawyer of Jose and Begonia join that application. The
chamber rejects it 'cos of the missing relevance to the taking of
evidences.
 
The chamber wants to close the taking of evidences. Following that
lawyer Ruppert makes an application to interrupt the trial 'cos today 
he
can only be present till 12:00
and wants to be present when the accuser does his final speech.
Begonias substitute lawyer declares that today he doesn't want to do 
the
pleading today. Judge Nohl assures him of that. When Nohl asks Begonia
she says the lawyer
of her choice from cologne will do the final speech.
The application of lawyer Ruppert is dismissed with the hint he could
obtain all details from lawyer Poell and this is the reason why there
are lawyers present.
 
What follows are the final speeches
At first: Prosecutor Geimer.
 
(comment: We tried to reproduce the final speeches of the prosecutor 
and
the joint plaintiff with the words they used. That we could not quote
everything is 'cos
we had no chance to write down excatly every word they used.
It is a pain to hear how they use the suffering of Mr. and Mrs. Schulz
and discredit Gabriels letter. And it is such a poor act that
"anarchists" "help" a prosecutor 
with his final speech. It hurts us to reproduce this so relaxed 'cos 
all
of the statements one has to question. These are final speeches of
lawyers who are aiming
at the maximum penalty...)
 
Final speech of the prosector:
Before he begins with his speech he declares that something like this
never happened before in his 25 year longing career as advocate for the
interests of the state.
On the one hand the behavior of the defendants, their behavior in court
and the intention to do this trial as a political one. On the other 
hand
the audience whose 
behavior was unbearable and who did a report after every day of the
trial one could read online. He rejects the political motives
vehemently. Regarding this he reads
a text where he quotes anarchists who declare that taking hostages has
nothing in common with anarchism, that a free society works without
violence (force) and
the defendants from Aachen are nothing but criminals. He uses this as
proof the trial is not a political one. It is blind solidarity and no
excuse.
All statements of the defendants were read after the taking of 
evidences
was done already that is why the statements must be seen as
constructions.
Concerning the points of the accusation he sees all of them as 
approved.
 
Accusation of Jose and Begonia about the bank robbery in Karlsruhe:
To him Jose is the for sure the committer of the bank hold-up 'cos he
was in Karlsruhe at this time the surveillance camera material convicts
him. He can't say for
sure that Begonia was his complice but she helped him on logistical
aspects since she lives in Karlsruhe and speaks german.
The fact of handling of stolen goods he sees as proved 'cos she was on
welfare, but bought a car for her brother and payed some debts.
 
Accusation of collusion for heist:
Two maps were found, wigs and walky talkies what indicates that they
were planning robberies. Nevertheless there are not enough proofs for
sentence on that.
 
Complex 3 and 4 of the accusation (control situation and chase)
Federal Frontier Guards testified the accused Jose and Gabriel had 
faked
papers with them, but they didn't realize this when checking it. The
situation escalated when they
said Jose should open the backpack what resulted in Jose and Gabriel
pulling their guns at the same time - this indicates they had an
arrangement on this.
 
Joint plaintill Schulz leaves the court room crying.
Geimer declares this is a proof he is still suffering from what
happened.
 
The hostages were forced to get into the car, Jose was driving and
witness Schulz sat right next to him. Bart was sitting in the back of
the car and so hindered Mrs. Schulz
to leave the car what makes him a complice. During the mad drive Jose
drove to the center of the city and 'cos of his life-threatening way of
driving Mrs. Weiss was slightly
injured when the first accident occured.
Gabriel was leaning out of the window and aimed at the car of the
Federal Frontier Police behind them. This was life-threatening to the
officers just as to the passersby 'cos
of possible richocets. Another life-threatening situation occured when
Jose was driving right through a group a passersby without using the
brakes. Only the prompt reaction of the passersby prevented harm. 
During
the escape Gabriel short various times at the car of the Federal
Frontier Police and again it was luck nothing happened. Because it was
not possible to go on with this car they had to change it. Before they
left with this new car Gabriel went to the car of Federal Frontier
Police and shot three times. A proof for this are the bullet casings. 
At
this time Bart had the chance to leave, but he remained inside the new
car and helped convincing witness Sommer to get into the car. But Mr.
Sommer could escape and the accused persons went to a shop and did dig
themselves in.
Begonia was resisting her arrestment, so the arrestment was rather
difficult just as the skilled officers affirmed. During the trial she
attracted attention by her arrogant behavior.
The guilt of Bart during the change of the car used for escape can be
determined.
The attempted murder the prosecutor derives from the firing off several
shots by Gabriel in combination with the valuation of the officers. He
points out that even the officers were old hands to them the situation
was very dangerous.
The missing criminal liabilty or reduced criminal liabilty - there is 
no
hint on that, the experts did clearly point it out.
Moral valuation: "What can be interceded for the defendants? NOTHING."
Begonia wasn't involved in the further deeds, that must be considered.
"What opposes the defendants? Massive use of force, brutality,
criminality."
The defense and the supporters show clear traits of belittlement. Mr.
Schulz is a proof for the heaviness of what happened 'cos even after a
year he can't stand staying inside the court room. A political
motivation of Gabriel and Jose can't be detected.
 
Concluding he states the citizens and the police must be protected by
court and justice as well: Only an insistent penalty can assure this.
The society needs to react on such a behavior to show that no one will
get away unpunished. Officers must be able to feel save. Political
motivations are just pleaded.
 
He demands the following sentence:
Jose:
Complex 1 (bank hold-up Karlsruhe): 5 years; Complex 2 (collusion to a
crime): acquittal; Complex 3 and 4 (resisting authority, intervention 
of
road traffic, mayhem, attempted armed roberry, taking hostages,
attempting murder): 12 years; Complex 5 (armed robbery, attempted
murder): 8 years
Overall duration of sentence: 15 years, without a chance to get 
released
earlier.
 
Gabriel:
Complex 2: (collusion to a crime); acquittal; Complex 3 and 4 
(resisting
authority, intervention of road traffic, mayhem, attempted armed
roberry, taking hostages, attempting murder): 12 years; Complex 5 
(armed
robbery, attempted murder): 10 years
Overall duration of sentence: 14 years, 9 months, without the chance to
get released earlier
 
Bart:
Complex 2: (collusion to a crime): 1 year, Complex 3 and 4 (resisting
authority, intervention of road traffic, mayhem, attempted armed
robbery, taking hostages, attempted murder): 4 years; Complex 5 (armed
robbery, attempted murder): 6 years
Overall duration of sentence: 7 years, without a chance to get released
earlier
 
Begonia:
Complex 1 (bank hold-up Karlsruhe): 1year, Complex 6 (resisting
authority): fine of 1200 Euro, 10 Euro a day
Overall duration of sentence: 13 months on probation
 
The wigs, weapons and the alleged money from the bank hold-up should be
confiscated.
 
Lawyer Poell declares the judges did already dismiss the accusation for
attempted murder. If the prosecutor now
comes up with this again he knows two applications he could make that
confute this. The first one would be the 
hearing of an officer who testified he saw the muzzle flash that means
the gun was pointed right at him what is
technically not possible. And the other application would deal with the
testimony three bullet casings were found 
what is not true as well 'cos the revolver couldn`t carry enough 
bullets
for that.
 
Final speech of the joint plaintiff:
The lawyer of the joint plaintiff just made some additions to what the
prosecutor already said. He pointed out the
hostages were not released, they escaped, still with panic another shot
could follow. Mrs. Schulz can`t participate
in the trial anymore, she just can`t stand it. What happened in court 
is
no tolerable treating of the court. The 
therapeutical method to handle what happened via being present in the
court room during the room was no
success. The traumata increased. It got so bad the marriage is in 
danger
now.
The apology Gabriel made to the former hostages with his letter doesn`t
deserve the label apology. Every
approach for excuse is followed by a "if" or "but". Not a single time 
he
says: I want to apologize. The worst
thing is the sentence: "I took away 5 minutes of your freedom, for me
this means years." Even if it had been
only 5 minutes (it was a lot longer, by the way), he didn't want to be
be the defendants on a mad drive, the
gun pointed at him. Regarding Mr. Schulz leaving the court room crying
he states: "Here it is no woman
that run away, a young man, but a man."
 
The judge asks the defense to do the final speech. The defense asks for
a five minute break. After
the break they declare to do the final speech all together which is
better than doing it in parts and lawyer
Ruppert isn`t present anymore and for Begonia only the
substitute-lawyer.
When asked Begonia says she wants the lawyer of her choice, Schulz, to
do the final speech which
is okay to the judge and the hint is made that her trial can be
separated from the one of the others.
 
The final speeches of the defense will be done during the next day of

This year more than 400 people took part in the protest that interacted with the prisoners inside through shouting mutual slogans and fireworks.
